Our Comprehensive Matrimonial & Family Law Services

Family law is a broad and intricate field. Our firm offers a full spectrum of services, ensuring that whatever your legal challenge, you have a dedicated expert by your side. We handle each case with the sensitivity and discretion it deserves, backed by formidable legal knowledge.

The Mutual Consent Divorce Path (Section 13B)

This is often the most amicable, efficient, and cost-effective route for couples who have mutually agreed to end their marriage. It signifies that both parties have resolved all core issues—custody, alimony, and property division—outside of court.

Our Role: We act as facilitators and negotiators, ensuring the settlement is fair, legally sound, and protects your long-term interests. We then draft and file the joint petition, guiding you through the court appearances.

The Legal Process:

  1. Filing the Joint Petition: We file a petition in the appropriate Family Court or District Court, stating that the couple has been living separately for one year and has mutually agreed to dissolve the marriage.
  2. First Motion (6-Month Cooling-Off Period): The court records the statements of both parties and grants a mandatory six-month “cooling-off” period. This period is intended for reconciliation, but with our strong, pre-negotiated settlement, it is often a formality.
  3. Second Motion & Final Decree: After six months, the couple must appear in court again for the “Second Motion.” The judge will re-examine if the terms of the settlement are still agreeable. Upon satisfaction, the court grants the final decree of divorce, officially dissolving the marriage. With the recent legal amendments, this six-month period can be waived by the court in certain circumstances, a motion we can expertly argue on your behalf.

Understanding Contested Divorce (Section 13)

A contested divorce is filed when one spouse wishes to end the marriage, but the other does not agree, or when the couple cannot agree on the terms of the settlement. This is a more complex and adversarial process that requires proving specific “grounds for divorce” as laid out in the relevant personal laws.

Common Grounds for Contested Divorce Include:

  • Adultery
  • Cruelty (Physical or Mental)
  • Desertion for a period of two or more years
  • Conversion to another religion
  • Unsoundness of mind or a virulent and incurable disease
  • Renunciation of the world

Our Role: As your dedicated legal advocates, we build a robust case by gathering evidence, examining witnesses, and presenting compelling arguments in court. Our focus is on protecting your rights, whether you are the one filing for divorce or defending yourself against unjust allegations. We are prepared for the rigors of litigation and will fight tirelessly to secure a just outcome.

The Child's Best Interest: Our Guiding Principle in Custody Matters

Child custody is the most sensitive aspect of any family dispute. The Indian legal system does not view a child as a property to be “won.” Instead, the singular, overriding principle that guides every court decision is the “welfare of the child.”

Our approach to custody is rooted in this principle. We prioritize creating co-parenting plans and custody arrangements that provide stability, love, and a healthy environment for the child. We believe in minimizing conflict to shield children from the trauma of legal battles.

Understanding Types of Custody:

  • Physical Custody: Determines who the child will live with on a day-to-day basis. The non-custodial parent is typically granted generous visitation rights.
  • Legal Custody: Grants a parent the right to make major decisions about the child’s life, including education, healthcare, and religious upbringing. Courts often favor joint legal custody, allowing both parents to remain involved in these critical decisions.
  • Joint Custody: An arrangement where both parents share both physical and legal custody, requiring a high degree of cooperation.

As your matrimonial lawyers in Delhi, we work to create a custody arrangement that is not only legally enforceable but also practically sustainable and, above all, in the absolute best interest of your child.
